Terms and Conditions

The following terms and conditions apply to the use of the OFWguru.com website (the “Site”). By accessing, browsing or using the Site, you agree to be bound by its terms and conditions.  


The Site reserves the right to revise these Terms and Conditions from time to time with or without notice.  If any such revision or modification is unacceptable to you, your only recourse is to cease from accessing the Site and to cancel your account. Your continued access and use of the Site following such revision or modification in the Terms and Conditions shall mean acceptance of, and assent to, such change.

 

Without prejudice to other rights existing under the laws or these Terms and Conditions, the Site reserves the right to change, suspend, restrict or cancel accounts or suspend or terminate access to the Site at any time, with or without notice, and based solely in its discretion. The Site or its administrators shall determine any breach or violation of these Terms and Conditions, based solely in its judgment and discretion. The Site or its administrators shall not be liable to any User or third party for any modification, change or restriction pertaining to a User’s access to, or services provided by, the Site.

 

DEFINITIONS

The following terms shall have the respective meanings specified below unless the context otherwise requires:


“Advertiser” means user who places a job advertisement or promotes any job related activities via the Site.


“Job Seeker(s)” means users seeking employment.


“Site” means OFWguru.com, or any website, job portal or mobile application owned and operated by OFWguru.com.


“User(s)” shall pertain to any person or entity accessing, browsing or using the Site in any manner, whether registered or not.

 

GENERAL USE


The Site is maintained solely to provide useful information for existing overseas Filipino workers or those who intend to work abroad, including, but not limited to, experiences shared by other overseas Filipino workers, listings of government agencies and information on available employment opportunities overseas. The Site does not (nor does it intend to) refer, contract, recruit, facilitate, promise or advertise any employment overseas. The Site is not intended to promote or refer any particular job searcher, recruitment agency or employer.  The Site or its administrators have no participation whatsoever on how Users shall use the information contained herein, or on the possible recruitment or engagement of any job seeker to a particular employment.  The Site does not make any representations or warranties regarding the contents or accuracy of the information that may be posted by its Users, and all Users are advised to exercise utmost diligence and caution in the use of information posted in the Site.

 

SPECIFIC USES


a.  Job Seekers


The Site is free to all Job Seekers.  No money is collected from Job Seekers for their use of the Site.


Jobseekers are advised to exercise due diligence and utmost caution in accepting job offers or in dealing with Advertisers or recruitment agencies. They are also advised to verify any information provided by Advertisers to ensure its accuracy.  Jobseekers are strongly advised to verify, check, or confirm with the Philippine Overseas Employment Agency (POEA), among others, the existence, status, registration and accreditation of all recruitment agencies and entities that they may interact and deal with through the Site.  OFWguru.com is not connected with, or related to, any private recruitment agency or entity, or any other entity that seeks to recruit and place workers for overseas employment. As such, OFWguru.com does not warrant their existence, legitimacy and authority to conduct business pursuant to applicable laws and regulations.       


Jobseekers agree to be responsible for maintaining the confidentiality of their log-in name, password or other account identifier which they choose and all activities that occur under their account. A Jobseeker’s account is personal to him and may not be used by another.


Jobseekers also agree not to create registration accounts for the purpose of abusing the Site or for the purpose of passing off oneself as another User.


Jobseekers agree to immediately notify the Site/ its administrators if they become aware of any unauthorized use of one’s log-in name, password or account identifiers by others.


Jobseekers also agree that any personal information which they post or release through the Site is given freely and voluntarily with full understanding that it may be accessible to any recruitment agency or entity subscribed to the Site. Jobseekers also agree to be responsible for the accuracy of any personal information which they post or make available to or through the Site, and the Site shall not be held liable in any manner whatsoever in connection with any and all such personal information.  In the same manner, the Site shall not be held responsible or liable in any way if an Advertiser, recruitment agency or entity uses one’s personal data for any purpose other than consideration for employment. Jobseekers agree to defend, indemnify and hold harmless the Site or any of its administrators from and against any claims, actions, demands or liability, arising or resulting from their use of the Site or violation of these Terms and Conditions.

 

b) Advertisers


Advertisers warrant that any information obtained from the Site shall be used solely for lawful activities. Advertisers agree that any information obtained from this Site shall not be compiled for any unauthorized use or sale to a third party.  Advertisers shall not communicate with, or obtain any personal information about, other Users, for purposes other than employment.


Advertisers are solely responsible in assuring that their job advertisements comply with existing labor laws. The Site may not be used for any activity that may be considered as illegal recruitment under Philippine laws. Advertisers also warrant that they shall be posting only job advertisements that would ultimately give valid working visas to applicants. Advertisements that offer other types of visas such as student visas, tourist visas, etc. are strictly prohibited.


Advertisers are prohibited from posting advertisements for their partner companies that are not licensed to recruit, place, and deploy Filipino workers overseas, including, but not limited to, consultancy services firm and travel agencies.


Advertisers shall be solely responsible for maintaining the security of their user ID and password. Advertisers shall not violate or attempt to violate the security of the Site by logging on or attempting to log on to an account that they are not authorized to access or by breaching or attempting to breach the Site’s security and authentication measures without proper authorization.


Advertisers agree to comply with notices, instructions and communications given or sent by the Site’s administrators pertaining to their use of the Site.


Advertisers shall not advertise or promote any products or services nor shall they post any content or link that is intended to promote other websites or promote any product or activity that is not related to employment.

 

INTELLECTUAL PROPERTY RIGHTS


All contents of the Site, including without limitation, information, text, graphics, images, layout, designs, pictures, logos, editorial content, HTML and other proprietary materials on the Site (collectively “Contents”) are the intellectual property of OFWguru.com or its licensors and are protected by copyright, trademark, and other intellectual property laws.


Users acknowledge and agree that the Contents are made available solely for their personal non-commercial use. No part or parts of the Site may be reproduced, disseminated, distributed, adapted, modified, published, displayed, broadcast, hyper-linked, framed or transmitted in any manner or by any means or stored in an information retrieval system without the prior written permission of OFWguru.com. Users, however, may download the Contents solely for their personal non-commercial use, provided that Users will not delete or amend any symbols or statements in the Contents that indicate the subsistence therein of copyright, trademark and any other proprietary rights. Users do not have any right, title or interest in or to any or any part of the Contents as a result of such downloading or copying.

The Site may contain links to third-party websites. These are provided solely for convenience to Users and as Internet navigation tools, and not in any way as an endorsement by OFWguru.com of the contents on such third-party websites. Unless otherwise stated on the Site, OFWguru.com has no control over or rights in such third-party websites and is not responsible for their availability or security. If users access any linked third-party websites, they do so entirely at their own risk. OFWguru.com shall not be responsible for the contents of any third-party websites linked to the Site or any links contained in such third-party websites or any changes or updates thereto, and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party websites. OFWguru.com shall not be responsible or liable for any loss or damage of any kind arising from or in connection with the use of the services or contents of such third-party websites.

 

INDEMNITY


By using the Site, you agree to defend, indemnify, and hold harmless the Site or any of its administrators (including its associated companies, officers, directors, employees, agents, successors and assigns) from and against any claims, actions, demands, injuries, liabilities, losses, damages, costs and expenses (including legal fees and litigation expenses on a full indemnity basis) arising from or relating to your use of the Site or its contents or from their breach of the Terms and Conditions, to the fullest extent permitted by applicable law. This indemnification shall be in addition to all other obligations of Users under the Terms and Conditions, and shall not prejudice any other rights or remedies available at law to OFWguru.com.
